Terms of Service
These Terms of Service ("Terms") govern your access to and use of TrustLayer Technologies B.V.'s website, API, and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use our Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Services Description
TrustLayer Technologies provides GeoIP intelligence, fraud detection, and risk scoring services via API. We offer various subscription plans with different usage limits, features, and service levels as described on our website.
3. Account Registration
To use our Services you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized use of your account
- Be responsible for all activities that occur under your account
4. Acceptable Use
You may use our Services only for lawful purposes. You agree not to:
- Use the Services to facilitate illegal activities
- Resell, redistribute, or sublicense the data without written permission
- Attempt to reverse engineer or extract our underlying databases
- Exceed the API rate limits specified in your plan
- Use the Services to harass, track, or surveil individuals without legal basis
- Violate any applicable privacy laws including the GDPR
5. Data License
Subject to these Terms and payment of applicable fees, TrustLayer grants you a limited, non-exclusive, non-transferable license to use the data and API outputs solely for your internal business purposes. All data provided through our Services is owned by TrustLayer Technologies or its licensors.
6. Fees and Payment
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated. You authorize us to charge your payment method for all fees incurred. If payment fails, we may suspend or terminate your access to the Services.
7. Service Level Agreement
We target 99.7% API availability. Planned maintenance windows will be announced at least 48 hours in advance. In the event of downtime exceeding our SLA, customers on paid plans may be eligible for service credits as described in our SLA documentation.
8. Intellectual Property
TrustLayer Technologies retains all rights, title, and interest in and to the Services, including all associated intellectual property rights. You retain all rights to your own data that you submit to the Services.
9. Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other party that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUSTLAYER TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Services. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
